You may not think California gun laws affect you. No matter where you live, there are local legislators studying California laws and seeking to bring them to your area. Politics is awash with money from eccentric billionaires who want to buy laws violating the U.S. Constitution. Office holders across the nation want to grab their share of this money.
Any one who has read the Bill of Rights knows that in America, the right to bear arms shall not be infringed. That has not stopped California from a marathon of anti-gun money fueled unconstitutional gun legislation. The latest defeat was a Federal Judge has blocked implementation of a sweeping law approved by the Legislature and voters last year which makes any magazine holding more than 10 rounds illegal. Law enforcement is exempt.
With the election of President Trump and the confirmation of Supreme Court Justice Neil M. Gorsuch, the Constitution is looking much more healthy, but we face years of court battles ending illegal laws across America.
Federal District Judge Roger Benitez ruled that the ban violates gun owners’ civil rights and amounts to the government taking people’s private property without compensation.
“The State of California’s desire to criminalize simple possession of a firearm magazine able to hold more than 10 rounds is precisely the type of policy choice that the Constitution takes off the table” the injunction read.
Last week, regulations implementing the equally unconstitutional prohibition of semi-auto rifles were rejected, leaving California with no system to register existing “California Assualt Weapons”. The registration deadline has been extended for six months to July 1st, 2018. Let’s hope a Federal Judge reads those regulations too.
